Peach Skin Sheets, L.L.C., d/b/a The Original PeachSkinSheets®, d/b/a PeachSkinSheets.com, d/b/a PeachSkinSheets ("PeachSkinSheets," "we," "us," or "our") values our customers and respects your privacy. This Privacy Policy (this "Policy") describes the personal information we collect about you, why we collect it, how we use, disclose, and protect it, and the choices and rights you have regarding that information. This Policy applies to information collected through peachskinsheets.com and any related sites, applications, and services (collectively, the "Site"), through our social media pages, at our sponsored events (including third-party events), and through offline interactions such as phone calls and emails.

This Policy is incorporated into and made a part of our Terms of Service. Any dispute between you and PeachSkinSheets regarding privacy or the collection, use, or disclosure of your personal information is subject to this Policy and our Terms of Service, including the limitation of liability, the mandatory individual arbitration provision, the class action waiver, and the informal dispute resolution requirements set forth in Section 24 of the Terms of Service.

By visiting or using the Site, or by providing your personal information to PeachSkinSheets, you acknowledge that you have read and understood this Policy and, to the fullest extent permitted by applicable law, consent to the collection, use, disclosure, and other processing of your information as described in this Policy. If you do not agree with this Policy, please do not use the Site or provide us your personal information.

Changes to This Policy

We may change this Policy from time to time. Any changes will be posted on this page, and material changes will be indicated by updating the "Last Updated" date at the top of this Policy. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Policy for information collected going forward, unless additional consent is required by applicable law. Please check this page periodically.

A Note About Children

The Site is intended for adults and is not directed to children. We do not knowingly collect personal information from anyone under the age of 16 (or under 13 for purposes of the Children's Online Privacy Protection Act). If we learn that we have collected personal information from a child under 16, we will delete that information as soon as reasonably possible. Personal Information We Collect

The personal information we collect depends on how you interact with us, the choices you make, and the products and features you use.

Information You Provide to Us. When you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including payment card numbers, which are processed by our payment processors), email address, and phone number ("Order Information"). We also collect personal information you voluntarily provide when you create an account, sign up for emails or texts, enter a contest or promotion, submit a review or other content, request customer support, use chat or messaging features, respond to surveys, or otherwise contact us. If you purchase a gift for someone else, we collect the recipient's name and shipping information in order to fulfill the order.

Information Collected Automatically. When you visit, use, or navigate the Site, we and our service providers automatically collect certain information about your device and your visit, including your web browser type and version, IP address, approximate location derived from your IP address, time zone, operating system, device identifiers, referring websites or search terms, the pages and products you view, the dates and times of your visits, how you interact with the Site (including clicks, scrolling, and information entered into forms), and cookies and similar identifiers installed on or read from your device ("Device Information"). This collection begins when you access the Site and may occur through technologies operated by us and by third parties, as described in the "Cookies and Tracking Technologies" and "Interest-Based Advertising" sections below.

Chat, Customer Service, and Session Analytics. If you use our chat features, call us, or contact customer service, we may collect the contents of those communications along with your contact information, and we may monitor or record those interactions for quality assurance, training, security, and record-keeping purposes. We may also use analytics and session replay technologies that monitor, record, and analyze how visitors interact with the Site, including mouse movements, clicks, scrolling, keystrokes, page views, and information entered into forms. By using the Site, its chat features, or our phone lines, you consent to this monitoring and recording to the fullest extent permitted by applicable law. If you do not consent, please discontinue use of the Site and contact us by mail instead.

Information from Other Sources. We may receive information about you from third-party sources, such as data providers, analytics companies, advertising and marketing partners, social media platforms (if you interact with us there, subject to your settings on those platforms), fraud prevention services, shipping carriers, referral programs, and retail or marketplace partners, and we may combine that information with information we collect directly.

When we refer to "personal information" in this Policy, we mean Order Information, Device Information, and the other information described above that identifies, relates to, or can reasonably be linked to you or your household.

Cookies and Tracking Technologies

We and third parties use cookies, pixels, tags, web beacons, scripts, software development kits, log files, and similar technologies (collectively, "cookies and tracking technologies") to operate the Site and collect Device Information.

"Cookies" are data files placed on your device that often include an anonymous unique identifier. "Log files" track actions occurring on the Site and collect data such as your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps. "Pixels," "tags," and "web beacons" are electronic files or snippets of code embedded in web pages or emails that record information about how you browse the Site or interact with our emails.

We use these technologies for the following general purposes:

Essential and operational purposes, such as enabling the shopping cart and checkout, keeping you logged in, remembering your cart between sessions, detecting and preventing fraud and security incidents, and making the Site function. These technologies are necessary to provide the Site and the services you request.

Analytics and performance purposes, such as understanding how visitors use the Site, which pages and products are most popular, and how our marketing campaigns perform, so that we can improve the Site and your experience. We use third-party analytics providers, such as Google Analytics, for these purposes. Personalization purposes, such as remembering your preferences and showing you content relevant to your interests.

Some cookies and tracking technologies — including those operated by third parties — may load or begin operating when you first access a page of the Site. Where required by applicable law, we present a cookie banner or consent-management tool that allows you to make choices about non-essential cookies, and we endeavor to configure non-essential technologies to respect the choices you make and applicable opt-out preference signals. Interest-Based Advertising and Identity Synchronization

We use your personal information, and permit third-party advertising companies to collect Device Information on the Site, to provide you with targeted advertisements and marketing communications we believe may be of interest to you, and to measure the effectiveness of our advertising.

We work with third-party advertising networks, platforms, and technology vendors — which may include, by way of example, Google (including Google Ads and Campaign Manager), Meta (Facebook/Instagram), Microsoft Advertising (Bing), Reddit, TikTok, Pinterest, AdRoll/NextRoll, and similar partners — that use cookies and tracking technologies on the Site to collect information about your activity on the Site and other websites over time. These companies use that information to serve you ads for our products on other websites, apps, and social media platforms, to measure ad performance, and to build or refine audience segments.

Some of our advertising partners and their vendors also participate in identity synchronization or "cookie syncing," in which advertising platforms and identity providers (which may include companies such as Tapad, AppNexus/Xandr, LiveIntent, and similar identity-resolution services) exchange pseudonymous identifiers — such as cookie IDs, device identifiers, or hashed email addresses — with one another so that they can recognize the same browser or device across different platforms. These exchanges may occur when you load pages of the Site and may transmit the page you are visiting (for example, our homepage URL as a referrer), your IP address, browser and operating system information, and pseudonymous advertising identifiers between those companies. These third parties act pursuant to their own privacy policies with respect to the information they process, and we encourage you to review them.

This practice — the disclosure of identifiers and internet activity information to advertising partners for cross-context behavioral advertising — may be considered a "sale" of personal information or "sharing" for targeted advertising under certain state privacy laws, even though we do not disclose your information to third parties in exchange for money. Your opt-out rights are described in the "Your Privacy Choices" and state-specific sections below.

Opt-outs are generally cookie-based and browser- and device-specific, so you must opt out on each browser and device you use, and you may need to renew your opt-out if you clear your cookies. Even after opting out, you will still see ads, but they will be less tailored to your interests.

How We Use Your Personal Information

We use the personal information we collect to:

  • Process, fulfill, and ship your orders, process payments and returns, and send order confirmations, shipping updates, invoices, and other transactional communications;
  • Create and administer your account and provide customer service and support;
  • Communicate with you, including responding to inquiries, requests, and reviews;
  • Send you marketing communications by email, text message, phone, postal mail, or other means about our products, services, contests, and promotions, in accordance with your preferences and applicable law;
  • Personalize and improve your shopping experience, our Site, and our products and services;
  • Administer contests, sweepstakes, surveys, and other promotions;
  • Perform analytics, understand our customer base and shopping preferences, and measure and improve our marketing and advertising;
  • Deliver and measure interest-based advertising, as described above;
  • Screen orders for fraud, abuse, and other risks and protect the security and integrity of our Site and business;
  • Enforce our Terms of Service and other policies, comply with legal and regulatory requirements, respond to legal requests, and prevent harm; and
  • Fulfill any other purpose disclosed to you at the time of collection or with your consent.

How We Disclose Your Personal Information

We disclose personal information for the business and commercial purposes described below. We do not disclose your personal information to third parties in exchange for monetary payment.

Service Providers. We share personal information with vendors, agents, contractors, and service providers who perform services on our behalf, such as e-commerce platform hosting (our store is hosted on Shopify Inc.; you can read Shopify's privacy policy at https://www.shopify.com/legal/privacy), payment processing, order fulfillment and shipping, fraud monitoring and prevention, identity verification, customer support, chat and messaging, email, SMS, and direct mail delivery, marketing and promotion fulfillment, surveys, analytics, and IT and security services. These providers are authorized to use personal information only as necessary to provide services to us and as permitted by law and our agreements with them.

Advertising and Analytics Partners. As described above, we disclose Device Information, identifiers, and internet activity information to advertising networks, analytics providers, and identity-resolution vendors for advertising, measurement, and analytics purposes. Under certain state laws, some of these disclosures may constitute a "sale" or "sharing" of personal information from which you may opt out.

Fraud Prevention. We share certain Order Information and Device Information with third parties who help us detect and prevent fraudulent transactions; these providers may use the information across the businesses they serve as described in their own privacy policies.

Affiliates. We may share personal information with our parents, subsidiaries, and affiliates, who will honor this Policy.

Promotional Partners. We may share your information when we team up with promotional partners to jointly offer products, services, contests, or promotions, with any additional disclosures provided at the time.

Legal Obligations and Protection. We may disclose your information to comply with applicable laws and regulations, to respond to a subpoena, warrant, court order, or other valid legal process or government request, to enforce our Terms of Service and other agreements, or to protect the rights, property, or safety of PeachSkinSheets, our customers, or others.

Business Transfers. If PeachSkinSheets is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our business or assets, personal information may be disclosed in connection with the evaluation of the transaction and transferred as a business asset in the transaction, subject to this Policy.

Aggregated and De-Identified Data. We may aggregate or de-identify personal information so that it can no longer reasonably be linked to you, and use and disclose such data for any lawful business purpose. Where we maintain de-identified data, we commit to maintaining it in de-identified form and not attempting to re-identify it, except as permitted by law to test our de-identification processes.

Your Privacy Choices; Do Not Sell or Share My Personal Information

We want you to understand your choices and be able to exercise them easily:

Sales and Sharing of Personal Information. PeachSkinSheets does not sell your personal information for money, and we do not sell the personal information of anyone we know to be under 16 years of age. However, like most online retailers, we use advertising cookies and disclose identifiers and internet activity data to advertising partners for cross-context behavioral (targeted) advertising, which may be considered a "sale" or "sharing" of personal information under certain state privacy laws. You have the right to opt out. You may do so by any of the following methods:

  • Using the "Your Privacy Choices" or "Do Not Sell or Share My Personal Information" link in the footer of the Site (where available) to disable advertising cookies;
  • Using our cookie banner or cookie-management tool to reject non-essential cookies;
  • Broadcasting an opt-out preference signal such as the Global Privacy Control (GPC) from your browser or browser extension, which we treat as a request to opt out of sale/sharing and targeted advertising for that browser where required by applicable law (learn more at https://globalprivacycontrol.org); or
  • Emailing us at legal@peachskinsheets.com with the subject line "Privacy Opt-Out."

Cookie- and signal-based opt-outs apply to the specific browser and device you use, so please repeat them on each browser and device, and renew them if you clear your cookies. Opt-outs do not apply to disclosures made before we receive your request or to disclosures to service providers acting on our behalf.

Email Marketing. You may unsubscribe from marketing emails at any time by clicking the unsubscribe link in any marketing email or by contacting us at legal@peachskinsheets.com. You will still receive transactional and administrative emails (such as order confirmations).

Text Messages. If you have opted into our SMS program, you can opt out at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message from us, as described in the SMS provisions of our Terms of Service.

Postal Mail and Phone. To opt out of promotional postal mail or phone contact, contact us using the information in the "Contact Us" section below.

Cookies. You can manage cookies through our cookie-management tool (where available) and your browser settings, as described in the "Cookies and Tracking Technologies" section above.

Do Not Track and Opt-Out Preference Signals

Some browsers offer a "Do Not Track" (DNT) setting. Because no uniform DNT standard has been adopted, the Site does not respond to DNT signals. However, as described above, we honor recognized opt-out preference signals such as the Global Privacy Control as opt-out-of-sale/sharing requests where required by applicable state law.

State-Specific Privacy Rights

California Residents

This section applies to California residents and supplements the rest of this Policy. It is provided pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, the "CCPA").

Categories of Personal Information We Collect. In the preceding 12 months, we have collected the following categories of personal information described in the CCPA: (A) Identifiers (such as name, postal address, email address, phone number, IP address, and online identifiers); (B) Personal information categories listed in Cal. Civ. Code § 1798.80(e) (such as name, address, telephone number, and payment card information processed by our payment processors); (D) Commercial information (such as products purchased, obtained, or considered, and purchasing histories or tendencies); (F) Internet or other electronic network activity information (such as browsing history, search history, and information about your interactions with the Site, our emails, and our advertisements); (G) Approximate geolocation data derived from IP address; and (K) Inferences drawn from the foregoing (such as shopping preferences). We do not knowingly collect biometric information, precise geolocation, or the contents of mail, email, or text messages directed to others, and we do not use sensitive personal information for purposes other than those permitted under the CCPA (such as processing your payment to fulfill your order and maintaining security).

Sources. We collect personal information directly from you, automatically from your devices through cookies and tracking technologies, and from third parties such as service providers, analytics and advertising partners, fraud prevention providers, social media platforms, and data providers.

Purposes. We collect, use, and disclose personal information for the business and commercial purposes described in the "How We Use Your Personal Information" and "How We Disclose Your Personal Information" sections above.

Disclosures, Sales, and Sharing. In the preceding 12 months, we have disclosed each of the categories listed above to service providers for business purposes. In the preceding 12 months, we have "sold" or "shared" (as those terms are defined by the CCPA) Identifiers and Internet or other electronic network activity information to or with advertising networks, analytics providers, and identity-resolution vendors for cross-context behavioral advertising and related purposes. We do not knowingly sell or share the personal information of consumers under 16 years of age.

Your CCPA Rights. Subject to certain exceptions, California residents have the right to: (1) know and access the personal information we have collected about you, including the categories of personal information, sources, purposes, and the categories of third parties to whom it was disclosed, sold, or shared; (2) delete personal information we have collected from you; (3) correct inaccurate personal information; (4) opt out of the sale or sharing of your personal information; (5) limit the use and disclosure of sensitive personal information (we do not use sensitive personal information for purposes requiring this right); and (6) not receive discriminatory treatment for exercising your rights.

Exercising Your Rights. You (or your authorized agent) may exercise your rights by emailing legal@peachskinsheets.com, calling 678-771-5326, or writing to Peach Skin Sheets LLC, 1225 Old Alpharetta Road Suite 295, Alpharetta, Georgia 30005. To opt out of sale/sharing, you may also use the methods described in "Your Privacy Choices" above, including the Global Privacy Control. We will verify requests to know, delete, or correct by matching information you provide against information we maintain (for example, by confirming control of the email address associated with your order); we cannot fulfill requests we cannot verify. Authorized agents must provide proof of authorization, and we may require you to verify your identity directly. We will respond to verifiable requests within 45 days, with a single 45-day extension where reasonably necessary and with notice to you. If we deny your request in whole or in part, we will explain why, and you may appeal by replying to our response or emailing legal@peachskinsheets.com.

Shine the Light. California Civil Code § 1798.83 permits California residents to request certain information regarding disclosure of personal information to third parties for those third parties' direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes without your consent. Notice of Financial Incentive. From time to time we may offer a discount (for example, a percentage off your first order) in exchange for signing up for our email or SMS marketing lists. The material terms will be presented at the time of the offer. The value of your personal information to us is reasonably related to the value of the discount, based on our expenses related to providing the offer. You may withdraw from the incentive at any time by unsubscribing from the applicable list.

Florida Residents

We endeavor to comply with Florida law applicable to our business, including the Florida Digital Bill of Rights (Fla. Stat. § 501.701 et seq.) to the extent applicable, and the Florida telemarketing and telephone solicitation statutes described in our Terms of Service. Florida residents may contact us using the information in "Contact Us" below to submit privacy requests, which we will honor to the extent required by applicable law. As described in the "Cookies and Tracking Technologies," "Chat, Customer Service, and Session Analytics," and "Interest-Based Advertising and Identity Synchronization" sections above, the Site uses tracking, analytics, advertising, and monitoring technologies operated by us and by third parties, and by using the Site you consent, to the fullest extent permitted by law, to the operation of those technologies and the associated collection and disclosure of Device Information. You can limit non-essential technologies at any time using the choices described in "Your Privacy Choices."

Health-Related Information and Wellness Content

We are a bedding and home products retailer, not a health care provider, and the Site is not intended to collect health information. The Site may contain general educational and wellness content — including articles or commentary from medical professionals regarding topics such as sleep, temperature regulation, perspiration, and menopause — and customer reviews and testimonials in which customers voluntarily describe their own experiences, including experiences with night sweats or hot flashes. This content is provided for general informational purposes only, is not medical advice, and should not be relied upon for diagnosis or treatment; our products are textiles that manage perspiration by wicking away moisture and drying quickly, and they do not treat, cure, or change any medical condition or your body chemistry.

Reading or viewing wellness content on the Site does not mean you are seeking health care services, and we do not treat your browsing of such content, your product purchases, or your product interests as health information. We do not build advertising audiences, marketing segments, or customer profiles based on actual or inferred health conditions, symptoms, diagnoses, or treatments. If you voluntarily share health-related information with us — for example, in a product review, survey response, chat, or customer service communication — we use it only for the purpose for which you provided it (such as displaying your review with your permission or responding to your inquiry), and we do not use it to profile you or to target advertising to you based on health status.

Washington Residents

We do not knowingly collect, use, share, or sell "consumer health data" as defined by the Washington My Health My Data Act (RCW 19.373), and we handle any health-related information you voluntarily provide as described in the "Health-Related Information and Wellness Content" section above. Because we do not collect consumer health data, we do not maintain a separate consumer health data privacy policy. If you believe we have inadvertently collected your consumer health data, contact us at legal@peachskinsheets.com and we will review and delete it as required by law. Washington residents who receive our marketing communications are also covered by the email and text message provisions of our Terms of Service, including our compliance efforts under the Washington Commercial Electronic Mail Act (RCW 19.190) and Washington's commercial telephone solicitation laws (RCW 19.158 and 80.36.390). Washington residents may exercise the privacy rights described in the multi-state section below. Residents of Nevada and Connecticut, which maintain similar consumer health data protections, are covered by the same practices described in this section.

New York Residents

We maintain a data security program with reasonable administrative, technical, and physical safeguards designed to comply with the New York SHIELD Act (N.Y. Gen. Bus. Law § 899-bb), as described in the "Security" section below. New York residents may contact us with privacy questions or requests using the information in "Contact Us" below.

Illinois Residents

We do not collect, capture, purchase, or otherwise obtain biometric identifiers or biometric information (such as fingerprints, faceprints, or voiceprints) as defined by the Illinois Biometric Information Privacy Act. Illinois residents (including residents of Chicago) may contact us with privacy questions or requests using the information in "Contact Us" below.

Colorado, Connecticut, Virginia, Texas, Oregon, Montana, Delaware, New Hampshire, New Jersey, Nebraska, Iowa, and Other States

If you reside in a state with a comprehensive consumer privacy law that applies to us, you may have some or all of the following rights, subject to that law's applicability thresholds, exceptions, and limitations: to confirm whether we process your personal information; to access it; to correct inaccuracies; to delete it; to obtain a portable copy; to opt out of targeted advertising, the sale of personal information, and profiling in furtherance of decisions that produce legal or similarly significant effects (we do not engage in such profiling); and to appeal a refusal to act on your request. You may exercise these rights by emailing legal@peachskinsheets.com, calling 678-771-5326, or writing to the address in "Contact Us" below, and you may opt out of targeted advertising and sale using the methods in "Your Privacy Choices," including the Global Privacy Control. If we deny your request, you may appeal by responding to our denial, and if your appeal is denied, you may contact your state Attorney General.

Nevada Residents

Nevada residents may direct us not to sell certain covered information as defined by Nevada law. We do not sell covered information for monetary consideration as defined by Nevada law; however, you may submit an opt-out request to legal@peachskinsheets.com, which we will honor should our practices change.

Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy — including maintaining your order history, providing services, resolving disputes, enforcing our agreements, and complying with tax, accounting, and other legal requirements — unless a longer retention period is required or permitted by law. When we no longer have an ongoing legitimate business need to retain your personal information, we will delete, anonymize, or securely isolate it. When you place an order through the Site, we may maintain your Order Information for our records unless and until you ask us to delete it, subject to legal retention requirements. How We Protect Your Information

We have implemented reasonable administrative, technical, and physical security measures, proportionate to the sensitivity of the information, designed to protect personal information from loss, theft, misuse, and unauthorized access, disclosure, alteration, or destruction. Payment card information is encrypted in transit and is processed and stored by our payment processors, not by PeachSkinSheets. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot promise or guarantee that unauthorized third parties will never defeat our security measures. Transmission of personal information to and from the Site is at your own risk, and you should only access the Site within a secure environment. If a breach affecting your information occurs, we will investigate and provide any notifications required by applicable law, including the data breach notification laws of your state.

International Visitors and Data Transfers

The Site is operated from the United States and is intended for visitors located in the United States. If you access the Site from outside the United States, you understand and agree that your personal information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those of your jurisdiction.

Third-Party Websites and Services

The Site may contain links to third-party websites, social media platforms, and payment services that are not governed by this Policy. We are not responsible for the privacy practices of third parties, and we encourage you to review the privacy policies of any third-party site or service you visit or use.

Supply Chain Transparency

PeachSkinSheets is committed to lawful, ethical sourcing and to combating forced labor, child labor, and human trafficking in our supply chain. Some of our products are sourced from suppliers located outside the United States, including in China. We expect our suppliers to comply with all applicable laws regarding labor, employment, and human rights, including prohibitions on forced, indentured, or child labor, and with U.S. import requirements, including the Uyghur Forced Labor Prevention Act. We reserve the right to request certifications from suppliers, to evaluate our supply chain for forced labor and trafficking risks, and to terminate relationships with suppliers that fail to meet our standards or applicable law.
